Sanctions Notice - Ukraine, Central African Republic and Russian Federation

Please be advised that there have been a number of developments in relation to the Bailiwick’s sanctions regime in relation to the Ukraine, the Central African Republic and the Russian Federation, which are set out below. Measures which should be taken as a result are set out at the end of this notice.

UKRAINE

Council Regulation (EU) 269/2014, as implemented by the Territorial Integrity etc. of Ukraine (Restrictive Measures) (Guernsey) Ordinance 2014, the Territorial Integrity etc. of Ukraine (Restrictive Measures) (Alderney) Ordinance 2014 and the Territorial Integrity etc. of Ukraine (Restrictive Measures) (Sark ) Ordinance 2014, has been amended by Council Implementing Regulation (EU) No 1225/2014 with effect from 19 November 2014, and by Council Implementing Regulation (EU) No 1270/2014 with effect from 29 November 2014.

The amendments, which are automatically effective in the Bailiwick, add 13 natural persons and 5 entities to the list of persons subject to an asset freeze and related financial prohibitions, and amend the information in relation to one existing designation.

RUSSIAN FEDERATION

Council Regulation (EU) 833/2014, as implemented by the Russian Federation (Restrictive Measures) (Guernsey) Ordinance 2014, the Russian Federation (Restrictive Measures) (Alderney) Ordinance 2014 and the Russian Federation (Restrictive Measures) (Sark ) Ordinance 2014, has been amended by Council Regulation (EU) No 1290/2014 with effect from 5 December 2014. The effect is to amend or clarify the prohibitions on making new loans or credit with a maturity exceeding 30 days to certain entities in certain circumstances, as well as the prohibitions and restrictions on the sale, supply or export of oil exploration and production projects in Russia and its Exclusive Economic Zone and Continental Shelf.

MEASURES WHICH SHOULD BE TAKEN

All businesses must check whether they maintain any accounts or otherwise hold any funds or economic resources for any person designated under the legislation listed above and treat any such accounts, funds or economic resources as frozen with immediate effect if this is not already the case. They must report any findings to the Policy Council immediately. Businesses must also refrain from making any funds or economic resources available directly or indirectly to any designated person unless licensed by the Policy Council.

The information referred to above is required by the Policy Council in the exercise of its powers under the Schedule to each of the Ordinances listed above.

Businesses must also familiarise themselves with the amendments to prohibited activity in respect of the Russian Federation.
