Sanctions Notice - Sudan and South Sudan

Please be advised of the amendments to the sanctions measures in place regarding Sudan and South Sudan have been made by the Legislation Select Committee.  These amendments, which have direct effect, are as follows:

Two EU Regulations have been implemented to provide clarity in relation to the sanctions it imposed in 2004 on Sudan by (a) recognising that Sudan and South Sudan are now separate countries, and (b) updating the sanctions by imposing new restrictions in relation to two South Sudanese individuals:

• EU Regulation 747/2014 is implemented through the Sudan (Restrictive Measures) (Guernsey) Ordinance, 2014 and concerns restrictive measures in Sudan; it repeals the Sudan (Provision of Technical Assistance, etc.) (Guernsey) Ordinance, 2004.  There were no additions to the list of designated persons subject to an asset freeze.
• EU Regulation 748/2014 is implemented through the South Sudan (Restrictive Measures) (Guernsey) Ordinance, 2014.  It concerns restrictive measures in South Sudan and imposes asset freezes and travel bans on two South Sudanese military leaders: SANTINO DENG and PETER GADET.

Both Regulations as modified by Ordinance require any information which would facilitate compliance, such as information on accounts and frozen assets, to be reported to the Policy Council immediately. 

Actions

• Check whether they have any business relationships, maintain any accounts or otherwise hold any funds or economic resources that relate to the activities prohibited by the EU Regulations referred to above.
• Report any findings to the Policy Council.
• Refrain from taking on or continuing any business which directly or indirectly supports the activities prohibited by these sanctions.
