Sanctions Notice - Russian Federation and Ukraine

​Please be advised that some amendments by the Council of the European Union to the sanctions measures in place regarding the Territorial Integrity etc. of the Ukraine and the Russian Federation have been published today with immediate effect.  These amendments, which have direct effect in the Bailiwick, are as follows;

Territorial Integrity etc. of the Ukraine

Council Regulation (EU) No 269/2014 of 17 March  2014 has been amended by Council Implementing Regulation (EU) No 961/2014 of 8 September 2014.  The effect of the amendments is the addition of the following to the list of designated persons subject to an asset freeze;

All financial services businesses in the Bailiwick must: 

• check whether they maintain any accounts or otherwise hold any funds or economic resources for the designated persons referred to above or for any  other designated person
• inform the Policy Council if they know or suspect that someone  is a designated person,  and  give details of any funds or economic resources they hold for any such person
• refrain from making any funds or economic resources available to these or any other designated persons.

Russian Federation

• Existing prohibitions on providing finance or financial assistance related to goods and technology on the Common Military List have been widened to include the provision of insurance and reinsurance;
• Existing prohibitions in respect of transferable securities and money-market instruments have been extended to those with a maturity exceeding 30 days if issued after 12 September 2014, and are now applicable to more categories of legal persons, entities or bodies;
• New prohibitions in respect of new loans or credit with a maturity exceeding 30 days have been introduced;
• New prohibitions have been introduced in respect of dual –use goods and technology to listed persons, entities or bodies, including the prohibition of technical or financial assistance in relation to such goods or technology;
• New prohibitions have been introduced in respect of the provision of associated services necessary for deep water or arctic oil exploration or production and shale oil projects in Russia.
