Sanctions Notice - Libya

The EU sanctions in relation to Libya have been implemented in the Bailiwick by the Libya (Restrictive Measures) (Guernsey) Ordinance, 2011, the Libya (Restrictive Measures) (Alderney) Ordinance, 2011 and the Libya (Restrictive Measures) (Sark) Ordinance, 2011.

An asset freeze no longer applies to Ahmed Mohammed Qadhaf Al Dam.  This change has taken place as a judgement by the General Court of the European Council on 24 September in case T-348/13 annulled those parts of Council Decisions and Regulations which added Ahmed Mohammed Qadhaf Al Dam to the list of persons subject to restrictive measures in view of the situation in Libya and was not appealed within two months of the judgement.

MEASURES WHICH SHOULD BE TAKEN

All businesses must take account of the judgement by the General Court of the European Council and familiarise themselves with the legislation referred to above. 

All businesses must check whether they maintain any accounts or otherwise have any kind of relationship with any natural or legal person, entity or body designated under the legislation and treat any accounts, funds or economic resources belonging to, owned, held or controlled by a designated person, entity or body as frozen with immediate effect if this is not already the case. Businesses must report any findings to the Policy Council immediately. Businesses must also refrain from making any funds or economic resources available directly or indirectly to or for the benefit of any designated person, entity or body unless authorised by the Policy Council.
