Sanctions Notice - Al-Qaida, Belarus, Federal Republic of Yugoslavia and Serbia, and the Russian Federation

​Please be advised that there have been a number of developments in relation to the Bailiwick’s sanctions regime, which are set out below.  These developments concern sanctions relating to the Al-Qaida network, Belarus, the Federal Republic of Yugoslavia and Serbia, and the Russian Federation.  Measures which should be taken as a result are set out at the end of this notice.

Council Regulation (EC) No 765/2006 of 18 May 2006, as implemented in the Bailiwick by the Belarus (Freezing of Funds) (Guernsey) Ordinance, 2006, the Belarus (Freezing of Funds) (Guernsey) Ordinance, 2006 and the Belarus (Freezing of Funds) (Guernsey) Ordinance, 2006 has been amended by Council Implementing Regulation (EU) No 1159/2014 of 30 October 2014.  The effect of the amendments, which are immediately effective in the Bailiwick, is to remove 24 individuals and 7 entities from the list of individuals and entities subject to an asset freeze and further financial restrictions, and to amend the details in respect of certain other persons.

Guidance on prohibitions and authorisations in respect of exports and related financial assistance under the EU’s sanctions against the Russian Federation has recently been issued by the UK’s Department of Business, Innovation and Skills and the Export Control Organisation.  It is available here: https://www.gov.uk/government/publications/eu-sanctions-against-russia-information-for-exporters.

Although the guidance concerns the approach of the UK authorities only and is neither applicable in the Bailiwick nor binding on its authorities, it is drawn to your attention on the basis that the Bailiwick authorities are likely to take a similar approach to that of the UK authorities in this area.

• Check whether they maintain any accounts or otherwise hold any funds or economic resources for any person designated under any of the Ordinances listed above (other than the Federal Republic of Yugoslavia (Freezing of Funds) Ordinance, 2001), and treat any such accounts, funds or economic resources as frozen with immediate effect if this is not already the case;
• Report any findings to the Policy Council immediately;
• Refrain from making any funds or economic resources available directly or indirectly to any designated person unless licensed by the Policy Council.
