Sanctions Notice - Al-Qaida and Terrorist Asset Freezing Measures

Please be advised that there have been a number of developments in relation to the Bailiwick’s sanctions regime, which are set out below.  These developments concern sanctions relating to the Al-Qaida network and terrorist asset freezing measures.  Measures which should be taken as a result are set out at the end of this notice.

AL–QAIDA NETWORK

Council Regulation (EC) No 881/2002 of 27 May 2002, as implemented in the Bailiwick by the Al-Qaida (Restrictive Measures) (Guernsey) Ordinance, 2013, the Al-Qaida (Restrictive Measures) (Alderney) Ordinance, 2013 and the Al-Qaida (Restrictive Measures) (Sark) Ordinance, 2013, has been amended by Commission Implementing Regulation (EU) No 1273/2014 of 28 November 2014.  The effect of the amendment, which is immediately effective in the Bailiwick, is to add the following legal persons to the list of entities subject to an asset freeze and related financial prohibitions:

Ansar Al Charia Derna

• Aliases: (a) Ansar al-Charia Derna;
• (b) Ansar al-Sharia Derna;
• (c) Ansar al Charia;
• (d) Ansar al-Sharia;
• (e) Ansar al Sharia).
• Other information: (a) Operates in Derna and Jebel Akhdar, Libya;
• (b) Support network in Tunisia.
• Date of designation referred to in Article 2a(4)(b): 19.11.2014.

Ansar Al Charia Benghazi

• Aliases: (a) Ansar al Charia;
• (b) Ansar al-Charia;
• (c) Ansar al-Sharia;
• (d) Ansar al-Charia Benghazi;
• (e) Ansar al-Sharia Benghazi;
• (f) Ansar al Charia in Libya (ASL);
• (g) Katibat Ansar al Charia;
• (h) Ansar al Sharia).
• Other information: (a) Operates in Benghazi, Libya;
• (b) Support network in Tunisia.
• Date of designation referred to in Article 2a(4)(b): 19.11.2014.

TERRORIST ASSET FREEZING MEASURES

With effect from 18 November 2014, HM Treasury revoked a designation for a designated person under the Terrorist Asset-Freezing etc. Act 2010.  This revocation is automatically and immediately applicable in the Bailiwick under the Terrorist Asset Freezing Law 2011.  Its effect is that the following person is no longer subject to an asset freeze and related financial prohibitions:

MEASURES WHICH SHOULD BE TAKEN

All businesses must: 

• Check whether they maintain any accounts or otherwise hold any funds or economic resources for any person designated under the legislation listed above and treat any such accounts, funds or economic resources as frozen with immediate effect if this is not already the case;
• Report any findings to the Policy Council immediately; and
• Refrain from making any funds or economic resources available directly or indirectly to any designated person unless licensed by the Policy Council.

The information referred to above is required by the Policy Council in the exercise of its powers under the Schedule to each of the Ordinances listed above and under section 18 of the Terrorist Asset Freezing Law.
